1. Introduction & Acceptance

Welcome to Physique AI. These Terms of Use ("Terms") govern your access to and use of the Physique AI mobile application ("App") and any related services (collectively, the "Service").

By downloading, accessing, or using Physique AI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

Age Requirement: You must be at least 18 years of age to use this Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, in some cases, providing additional notice (such as an in-app notification). Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Physique AI is a mobile application that uses advanced artificial intelligence to provide:

  • AI-Powered Body Analysis: Processing of uploaded photos to estimate body composition and physique metrics.
  • Fitness Recommendations: Personalized guidance based on your physical data and goals.
  • Progress Tracking: Tools to monitor your fitness journey over time.
  • Physique AI Pro: Enhanced features and unlimited analyses available via subscription.

Important: All results provided by the App are estimates for informational purposes only. The Service does not provide medical advice, diagnosis, or treatment.

3. User Accounts & Registration

To access certain features of the App, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials (password/biometrics).
  • Not share your account with others.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our sole discretion if we suspect any violation of these Terms or illegal activity.

4. Acceptable Use & Prohibited Activities

You agree to use Physique AI only for lawful purposes. You are prohibited from:

  • Uploading inappropriate, offensive, or sexually explicit content.
  • Uploading photos of other people without their express consent.
  • Attempting to reverse engineer, decompile, or extract source code from the AI models or App.
  • Using automated systems (bots, scrapers) to access the Service.
  • Using the App for commercial purposes without our prior written consent.
  • Harassing, abusing, or harming other users or our staff.

5. User Content & Photos

You retain full ownership of all photos and data you upload to Physique AI. However, to provide the Service, we require a limited license:

License Grant: By uploading content, you grant Physique AI a worldwide, non-exclusive, royalty-free license to process, analyze, and store your photos solely for the purpose of providing the Service to you.

  • Privacy: Photos are processed securely and are NOT shared with third parties for their own marketing purposes.
  • Responsibility: You represent that you have all necessary rights to the photos you upload.
  • Minors: You are strictly prohibited from uploading photos of minors.

6. Subscriptions & Payments

Physique AI Pro is an auto-renewable subscription service that provides unlimited analyses, detailed scoring, and advanced features.

  • Billing: Subscriptions are typically charged on a weekly basis through your Apple App Store account.
  • Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Management: You can manage or cancel your subscription anytime in your App Store Account Settings.
  • Refunds: Payments are processed by Apple. Refund requests must be directed to Apple Support and are subject to Apple's refund policies.
  • Price Changes: We reserve the right to change subscription pricing with notice. Continued use after a price change constitutes acceptance.

7. Referral Program

We may offer rewards for inviting friends to join Physique AI.

  • Rules: Each user has a unique referral code. You cannot refer yourself or create fake accounts to earn credits.
  • Revocation: We reserve the right to revoke referral credits or terminate accounts if we detect fraudulent activity or abuse of the program.
  • Non-Transferable: Referral credits have no cash value and cannot be transferred or sold.

8. Intellectual Property

All rights, title, and interest in and to the Service, including the App design, logos, AI models, algorithms, and content, are the exclusive property of Physique AI and its licensors.

Limited License: We grant you a personal, non-exclusive, non-transferable license to use the App for your own personal, non-commercial fitness tracking.

You may not copy, modify, distribute, or create derivative works of any part of the App without our express written permission.

9. Disclaimers & Limitations

Medical Disclaimer

Physique AI is NOT a medical device. The guidance provided is for motivational and educational purposes only. Always consult with a qualified healthcare professional before starting a new diet or exercise program. We are not responsible for any health problems or injuries resulting from your use of the Service.

AI Accuracy: While our AI is advanced, body composition estimates can be affected by lighting, pose, and other factors. Results are NOT guaranteed to be 100% accurate.

No Warranty: The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express or implied.

Limitation of Liability: To the maximum extent permitted by law, Physique AI shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Privacy & Data

Your privacy is critical to us. Please review our Privacy Policy to understand how we collect and use your data.

  • Storage: We use secure services like Firebase to store your account and fitness data.
  • Deletion: You have the right to delete your account and all associated data at any time via the App settings.

11. Third-Party Services

The App integrates with third-party services (such as Firebase, OpenAI, and Vercel). Your use of the Service is also subject to their respective terms and conditions. We are not responsible for any outages or issues caused by these third-party providers.

12. Termination

You may stop using the Service and delete your account at any time. We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms.

13. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.

Any dispute arising from these Terms will be resolved through individual binding arbitration. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

14. Changes to Terms

We may revise these Terms from time to time. The most current version will always be at https://aryansudhirdev.github.io/terms.html. By continuing to use the App after revisions become effective, you agree to be bound by the updated Terms.

16. Severability
